Welcome to scoopzicecream.ca (the “Site”), operated by Scoopz Ice Cream Hut Ltd. (“Scoopz,” “we,” “our,” or “us”). By accessing, browsing, or using this Site, you (the “User” or “you”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please refrain from using the Site.

1. Use of the Site
1.1 Eligibility – You must be 13 years of age or older (or have parental permission) to use the Site.
1.2 Permitted Use – The Site is provided solely for informational purposes, event inquiries, and booking requests. You may not copy, scrape, reproduce, modify, distribute, or exploit any Site content without our prior written consent.
1.3 Prohibited Conduct – You agree not to:

2. Booking Requests
2.1 Inquiry‑Only – Submission of a booking form or email inquiry is a request, not a confirmed reservation. A booking is secured only after Scoopz sends a written confirmation.
2.2 Deposits & Payments – Scoopz does not accept online payments through the website. All deposits and balances are handled in person or via agreed offline methods (e.g., cash, Interac e‑Transfer, invoice).
2.3 Cancellations – If you need to cancel, please notify us in writing no later than 72 hours prior to the event. Late cancellations may incur a fee to cover scheduling and preparation costs.
2.4 Allergy & Dietary Information – Scoopz serves Foothills Creamery products that may contain common allergens (e.g., dairy, nuts, gluten). It is your responsibility to notify guests and obtain any required allergy disclosures.

3. Intellectual Property
All content on the Site—including text, logos, graphics, photos, videos, icons, and layout—is owned by Scoopz or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual‑property laws. Unauthorized use is strictly prohibited.

4. User‑Generated Content
If you tag, post, or send photos, reviews, or other materials to Scoopz via the Site or social media (“User Content”), you grant Scoopz a non‑exclusive, royalty‑free, worldwide licence to use, reproduce, and display that content for promotional purposes. You represent that you own or have permission to share such content and that it does not infringe third‑party rights.

5. Third‑Party Links
The Site may contain links to third‑party websites (e.g., social‑media platforms). These sites are not controlled by Scoopz. We are not responsible for their content, privacy practices, or availability. Access them at your own risk.

6. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available.” While we strive for accuracy, Scoopz makes no warranties, express or implied, regarding the Site, including but not limited to merchantability, fitness for a particular purpose, non‑infringement, accuracy, or uninterrupted service.

To the fullest extent permitted by law, Scoopz, its owners, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or related to:

any event‑booking issues beyond our reasonable control.
If liability cannot be disclaimed, it is limited to CAD $100 or the amount you paid to Scoopz for the specific event giving rise to the claim, whichever is less.

You agree to defend, indemnify, and hold harmless Scoopz and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your breach of these Terms, your misuse of the Site, or your infringement of any intellectual‑property or other rights.

9. Privacy
Personal information collected through the Site is handled in accordance with our Privacy Policy, which forms part of these Terms. By using the Site, you consent to our data‑handling practices described therein.

10. Modifications
Scoopz may modify these Terms at any time. Changes take effect upon posting the updated Terms on this page, with the “Last updated” date revised. Continued use of the Site after changes constitutes acceptance of the new Terms.

11. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict‑of‑law provisions. Any disputes shall be resolved exclusively in the courts of Alberta.

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
